நாவரசு கொலை வழக்கில் ஜான் டேவிட்டுக்கு 3 நாள் பரோல்

       சிதம்பரம் அண்ணாமலைப் பல்கலைக்கழக மாணவர் நாவரசு கொலை வழக்கில், ஆயுள் தண்டனை கைதியாக கடலூர் மத்திய சிறையில் அடைக்கப்பட்டுள்ள வரும் ஜான் டேவிட்டுக்கு, அவரது தந்தை மரணம் காரணமாக 3 நாள் பரோலில் செல்ல அனுமதி வழங்கப்பட்டுள்ளது. 

            சென்னை பல்கலைக்கழக துணை வேந்தராக இருந்த பொன்னுசாமியின் மகன் நாவரசு. இவர், சிதம்பரம் அண்ணாமலைப் பல்கலைக்கழகத்தில் 1996-ம் ஆண்டு, மருத்துவம் முதலாண்டு படித்துக் கொண்டிருந்தார். அப்போது நாவரசுவை, அதே மருத்துவக் கல்லூரியின் 2-ம் ஆண்டு மாணவரான ஜான் டேவிட், கொடூரமாகக் கொலை செய்தார்.  இக்கொலை வழக்கில் ஜான் டேவிட்டுக்கு கடலூர் மாவட்ட செசன்ஸ் நீதிமன்றம் 11-3-1998 அன்று, ஆயுள் தண்டனை விதித்தது. ஜான் டேவிட், கடலூர் மத்திய சிறையில் அடைக்கப்பட்டார். சுமார் 5 ஆண்டுகள் சிறைவாசத்துக்கு பின்னர், அவரது மேல்முறையீட்டு மனுவை விசாரித்த சென்னை உயர் நீதிமன்றம், ஜான் டேவிட்டை விடுதலை செய்து உத்தரவிட்டது. 

            ஆனால் உயர் நீதிமன்றத் தீர்ப்பை எதிர்த்து தமிழக அரசு, உச்ச நீதிமன்றத்தில் மேல்முறையீடு செய்தது. 20-4-2011 அன்று உச்ச நீதிமன்றம் ஜான் டேவிட்டுக்கு, ஆயுள் தண்டனையை உறுதி செய்து தீர்ப்பளித்தது. 23-4-2011 அன்று, ஜான் டேவிட் மீண்டும் கடலூர் மத்திய சிறையில் அடைக்கப்பட்டார்.  இந்த நிலையில் உடல் நிலை சரியில்லாமல் இருந்த ஜான் டேவிட்டின் தந்தை மாரிமுத்து, சென்னையில் உள்ள தனியார் மருத்துவமனையில் செவ்வாய்கிழமை இறந்தார். தந்தையின் இறுதிச் சடங்கில் கலந்துகொள்ள, பரோலில் செல்ல அனுமதி அளிக்குமாறு ஜான் டேவிட் கோரிக்கை மனு அளித்தார். 

       மனுவை ஏற்றுக் கொண்ட சிறைத்துறை, அவருக்கு 3 நாள் பரோலில் செல்ல அனுமதி அளித்துள்ளது. ஒரு சப்-இன்ஸ்பெக்டர் தலைமையில் 4 போலீஸ் காவலர்கள் அடங்கிய பாதுகாப்புடன், ஜான் டேவிட் செவ்வாய்க்கிழமை சென்னைக்கு அழைத்துச் செல்லப்பட்டார்.

நாவரசு கொலை வழக்கில் ஜான் டேவிட்டை விடுதலை செய்யக்கோரிய மனு தள்ளுபடி

             சிதம்பரம் அண்ணாமலை மருத்துவ பல்கலைக்கழகத்தில் ஜான்டேவிட் மருத்துவக் கல்வி பயின்றார். அவருடன் சென்னை பல்கலைக்கழகத்தின் முன்னாள் துணைவேந்தரின் மகன் நாவரசு மருத்துவக் கல்வி படித்தார்.

                   இந்த நிலையில் நாவரசு கொலை செய்யப்பட்டார். இந்த வழக்கில் ஜான் டேவிட்டுக்கு ஆயுள் தண்டனை விதித்து 11.3.98 அன்று கடலூர் செசன்சு கோர்ட்டு உத்தரவிட்டது. செசன்சு கோர்ட்டு உத்தரவை எதிர்த்து சென்னை ஐகோர்ட்டில் ஜான் டேவிட் மேல்முறையீடு செய்தார். இந்த மனுவை விசாரித்த ஐகோர்ட்டு, ஜான் டேவிட்டை 5.10.01 அன்று விடுதலை செய்து உத்தரவிட்டது. பின்னர் போலீஸ் தரப்பில் சுப்ரீம் கோர்ட்டில் மேல்முறையீடு செய்யப்பட்டது.

           அந்த வழக்கை விசாரித்த சுப்ரீம் கோர்ட்டு, செசன்சு கோர்ட்டு பிறப்பித்த ஆயுள் தண்டனை தீர்ப்பை உறுதி செய்து 20.4.11 அன்று உத்தரவிட்டது. தற்போது ஜான் டேவிட் கடலூர் மத்திய சிறையில் அடைக்கப்பட்டுள்ளார். இந்த நிலையில் சென்னை ஐகோர்ட்டில் அவரது தாயார் எஸ்தர் ஆள்கொணர்வு மனு ஒன்றை தாக்கல் செய்தார். அதில், ஜான் டேவிட்டுக்கு ஆயுள் தண்டனை விதித்து செசன்சு கோர்ட்டு தீர்ப்பளித்தபோது, அவரது வயதை கருதாமல் பொது சிறையில் அடைத்துவிட்டனர்.

               சிறுவராக இருக்கும் ஒருவரை சிறுவர் சீர்திருத்தச் சட்டப்படி பொது சிறையில் அடைக்கக் கூடாது. சிறுவர் இல்லங்களில்தான் வைக்க வேண்டும். 21 வயதுக்கும் மேற்பட்டவரைத்தான் பொது ஜெயிலில் அடைக்க முடியும். எனவே ஜான் டேவிட்டை பொது சிறையில் அடைத்தது சிறுவர் சீர்திருத்தச் சட்டத்தை மீறியதாகும். சட்டவிரோத காவலில் அவரை போலீசார் அடைத்திருந்தனர். எனவே இந்த சட்டவிரோத நடவடிக்கைக்காக ஜான் டேவிட்டை விடுதலை செய்து உத்தரவிட வேண்டும் என்று கூறப்பட்டுள்ளது.

                 இந்த மனுவை நீதிபதிகள் சி.நாகப்பன், எம்.சத்தியநாராயணன் ஆகியோர் விசாரித்தனர். அப்போது, இந்த பிரச்சினை தொடர்பாக சம்பந்தப்பட்ட கோர்ட்டில் வழக்கு தாக்கல் செய்ய இருப்பதால், மனுவை திரும்பப் பெறுவதாக எஸ்தர் தரப்பில் வக்கீல் குறிப்பிட்டார். மனு திரும்பப் பெறப்பட்டதை அடுத்து மனுவை நீதிபதிகள் தள்ளுபடி செய்து உத்தரவிட்டனர்.

Petition seeking release of lifer dismissed release of John David

             The Madras High Court today dismissed as withdrawn, a petition seeking the production and release of John David, serving life imprisonment for the 1996 murder of a first year medical student. The petition's mother J Esther said that at the time of murder her son was 19-years-old and 20 years when convicted in 1998. She submitted that as per the Tamil Nadu Borstal Schools Act and a ruling of the Supreme Court, "adolescent offenders" had to be detained in a Borstal School only upto 23 years of age. Therefore, he could not be sent to prison to serve the remaining part of the sentence. 

              Hence, the detention of her son, who had crossed the age of 23 years, was illegal, the petitioner claimed. On March 11, 1998, a Cuddalore District Sessions Judge had sentenced David, a second-year medical student to a double life imprisonment for murdering Pon Navarasu, son of former Madras University Vice-Chancellor Dr P K Ponnusamy. David was, however, absolved of the crime by the Madras High Court on October 5, 2001. On April 20 last the Supreme court overturned the High Court order and restored the trial court's verdict. Recording an endorsement by the petitioner's counsel withdrawing the petition with the liberty to raise the plea before the appropriate court, a Division Bench comprising Justices C Nagappan and M Satyanarayanan dismissed the petition as withdrawn.

நாவரசு கொலை வழக்கில் ஜான்டேவிட் தனி அறையில் அடைப்பு

            மருத்துவக்கல்லூரி மாணவர் நாவரசு கொலை வழக்கில் இரட்டை ஆயுள் தண்டனை பெற்ற குற்றவாளி ஜான் டேவிட் கடலூர் மத்திய சிறையில் தனி அறையில் அடைக்கப்பட்டுள்ளார்.

ஜெயிலில் அவரது நடவடிக்கைகள் பற்றி அதிகாரி ஒருவர் கூறியது: 

             ஜான்டேவிட் ஒரு பிரபலமான கைதியாக கருதப்படுகிறார். இதனால் அவரை கடலூர் மத்திய ஆண்கள் ஜெயிலில் சென்ட்ரல் பிளாக்கில் தனி அறையில் அடைத்துள்ளோம். இதுபோன்ற பிரபலமான கைதிகளை சில நாட்கள் தனிமை சிறையில்தான் அடைப்பது வழக்கம். ஏனென்றால் மற்ற கைதிகள் அவரோடு எப்படி பழகுகிறார்கள் என்பதை தீர்மானித்த பிறகுதான், மற்ற கைதிகளோடு அடைப்பதற்கு நடவடிக்கை எடுக்கப்படும். அந்த வகையில்தான் ஜான்டேவிட்டை தனி அறையில் அடைத்துள்ளோம்.

               அவர் ஜெயிலுக்கு வந்தவுடன் முகத்தில் எந்தவிதமான கவலையையோ, பயத்தையோ காட்டவில்லை. சர்வசாதாரணமாகவும், இயல்பாகவும் காணப்பட்டார். ஜெயிலில் வழங்கப்படும் சாப்பாட்டை நன்றாக சாப்பிடுகிறார். இரவிலும் நன்றாக தூங்குகிறார். மற்ற கைதிகள் அவரிடம் ஏதாவது பேசினால் சிரிப்பை மட்டுமே பதிலாக காட்டுகிறார். இரவில் தூங்குவதற்கு முன்பு பைபிள் படிக்கிறார். நாங்கள் எதிர்பார்த்ததுபோல் இல்லாமல் அவர் மிகவும் இயல்பாக காணப்படுகிறார் என்று அந்த அதிகாரி தெரிவித்தார்.

Lookout notice for John David convicted in the Navarasu murder case

CUDDALORE: 

           A lookout notice has been issued to trace the whereabouts of John David, convicted in the Navarasu murder case, according to Superintendent of Police Ashwin Kotnis.

             Mr. Kotnis told the presspersons here on Thursday that following the Supreme Court upholding the Cuddalore Sessions Court's verdict of double life sentence awarded to John David in the case, the Annamalai Nagar Police (under whose jurisdiction the college falls) had been directed to pursue the matter.

           The SP said special teams had been formed to conduct enquiry at places such as Karur (said to be John David's native place), Tiruchi and Chennai. He underscored the point that the legal process would have to be followed in which the Supreme Court would have to give the direction to the Madras High Court and the latter in turn would have to instruct the trial court (Cuddalore Sessions Court) to issue the arrest warrant.

          Mr. Kotnis said the report of John David having become a priest in Australia had to be verified, adding that vigil had been mounted at airports. Navarasu, son of former Vice-Chancellor of Madras University K.Ponnuswamy, and a fresher at the Rajah Muthiah Medical College of Annamalai University, Chidambaram, was reported missing from the college hostel from November 6, 1996.

           The prosecution version had it that after Navarasu's mutilated torso was found in Chennai facts emerged that the victim's hostel mate John David had committed the gruesome murder, pursuant to a ragging incident. Though the trial court had sentenced John David to undergo two life sentences consecutively, the Madras High Court acquitted him of the charges. A special leave petition was filed in the Supreme Court contesting the High Court judgment. The Supreme Court Bench set aside the High Court verdict and restored the trial court judgment with a change that the two life sentences should run concurrently.
