The Madras high court has directed the government to take action on a report by the Cuddalore Revenue Divisional Officer (RDO) on an alleged case of custodial torture and death at the Cuddalore central prison.
A petition by Palani (65) from Pattalam said his son Amul Babu (29) was arrested and lodged at the Vellore Central Prison. On July 14, 2009, he was shifted to the Cuddalore prison as he was an AIDS patient. On August 4, Palani said he was informed by prison officials that his son had dashed against a wall and was later declared dead at the Government Hospital. Palani, who later saw bruises on his son's body, said he found that Amul Babu was brutally beaten by prison staff on the night of August 3.
A complaint was sent to the Home Secretary on August 14, 2009 against the deputy jailor but no action was taken. The petition sought action against the prison warders. Palani also wanted the government to award him compensation. The home department's counter affidavit said the RDO in Cuddalore had conducted a magisterial inquiry and a final decision was yet to be taken. Appropriate orders would be issued to initiate criminal or departmental action against erring prison officials if they were found to be involved in the death of the remand prisoner, it said. "As per a GO dated January 31, 1998, Rs 1 lakh could be sanctioned to the victims of police torture. ," the counter affidavit said.
Passing orders, Justice D Hariparanthaman directed the home department to pass orders on the report of the RDO, Cuddalore within three weeks.
